Important information for tobacco and e-cigarette retailers in NSW
E-cigarettes, tobacco and non-tobacco smoking products cannot be sold to anyone under the age of 18. A retailer or employee must be sure the customer is over 18 before selling these products to them.
It is illegal to sell e-cigarettes that contain nicotine
The sale of liquid nicotine in e-cigarettes and e-liquids is illegal in NSW. This includes online sale.
E-cigarettes that are designed to be disposed of after use often contain liquid nicotine and cannot be sold in NSW.
NSW Health inspectors can seize and destroy products, and prosecute retailers who break the law.
NSW Health inspectors visit tobacco retailers and vaping stores to check if products containing liquid nicotine are being sold.
They also check if products are being sold to people under 18 years of age.
NSW Health inspectors can seize and destroy e-cigarette and e-liquid products that are labelled as containing nicotine, or are suspected of containing nicotine
NSW Health can prosecute retailers for selling these products.
NSW Health can also prosecute retailers for selling tobacco or e-cigarettes to people under 18 years of age.
